• Booking Amount Refund Query

Dear folks,

I had booked a villa here in Bangalore and for the same I paid the builder a sum of 1Lakh. Now I have cancelled the plan of purchasing it. I have spoken with the builder about the refund, he will be giving me the cheque but he is asking for the original receipt. 

Now my concern is, if I give away the original receipt and the cheque bounces, then what proof do I have for my money. 

Can I go ahead and give him the original receipt?

Kindly advice.

1) ask builder to give in writing that he wants original receipt to proceess your refund application

2) obtain an acknowledgment from builder that original receipt has been paid to him to process your refund

3) if builder is willing to give in writing then you can forward orignal l receipt to the builder

4) keep a xerox copy of original receipt for your records

Dear Sir/Madam, you have to return the original receipt subject to condition of realization of cheque which was refunding you. Before going to make one settlement deed for the same with subject to condition or realization of cheque.

1. You tell the builder that you would be handing over the original receipt after you receive refund of advance/clearing of cheque.

2. Or else he has to acknowledge having received the original receipt in lieu of his giving you the refund cheque.

You can give the original receipt and take an acknowledgement that he received the original receipt, this will be an evidence to file cheque bonce cae or money recovery casein case the cheque is bounced back without being honored.

Retain a copy of the original receipt and obtain an acknowledgment from him that the original receipt has been returned to him as per his demand. This should safeguard you.
