• Power of Attorney revoke from abroad

I had sent my General Power Of Attorney to my relative in India last month. But, now due to some trustworthiness issue I would like to revoke the GPA.

What I had done:
•	I & my business partner are combine owners in 2 properties situated in India.
•	Signed a common GPA for both partners to a common attorney residing in India. 
•	We had signed & attested a GPA from Indian embassy in UAE.
•	Than my relative registered the GPA at sub-registrar office in India.

Now,
•	Due to some reasons I cannot travel to India now.
•	I want to revoke the GPA on immediate basis, but my partner is not willing to revoke.
•	Irrespective of the effect on the common GPA, how can I revoke my stake of property GPA on immediate basis staying in UAE? 
•	How much time does it take to revoke a GPA?

1) issue notice to holder of power of attorney that power of attorney granted to him to act on your behalf is hereby revoked

2) issue public notice of revocation of power of attorney

3) since POA is registered deed of revocation of power of attorney would also require to be registered

4) you would have to come down to India to register deed of revocation of POA

1. You have to execute a deed of revocation of GPA before the sub-registrar. If you cannot travel personally to India then you may execute a power of attorney in favour of a relative/friend in India to authorize him to register the deed of revocation for and on your behalf.

2. The GPA has to be attested before the Indian Consulate.

3. Serve a lawyer's notice to the attorney holder to immediately stop acting under the GPA.

1. you have right to revoke GPOA any time without prior notice.

2. you can do so even in common GPOA because you have right to revoke it and its exercise is not based upon consent of other party.

3. when you revoke this poa then GPOA became Infructuous and your partner need to make afresh GPOA with his signature only.

4. when one co owner has revoked GPOA then other co owner cannot sell it by GPOA.

1. You can execute the Revocation Deed from the place where you are presently located and then notiarise and attest it in the same manner you did the GPA.

2.You alone can also revoke the GPA in that event the attorney would no meo be your agent and hence his acts will not cover the whole of the proeprty.

3. It takes 2-3 days to revoke the GPA.

Dear Querist

you may issue a letter or legal notice to sub registrar in India By post or through lawyer regarding the revocation of this GPA due to your personal reason and the same should be published in the Two leading News papers in India. apart from this if the GPA/POA was attested in UAE then it will be better to issue a letter to that attested authority too.

there is no need for personal appearance.

1. Send a registered letter to your GPA holder clearly informing him that you have revoked the power you have conferred upon him vide the said joint GPA executed and notarised by you and your partner.

2. If one of the co-executor of the said GPA revokes the power conferred by him, the common GPA will become invalid.

3.Thereafter release a notice in two local newspapers, one being in vernacular, notifying the public in general about your such revocation of the GPA.

For revocation of a registered GPA, you have to execute a registered cancellation deed, then only the registered GPA shall stand revoked.

However as preliminary measure you may issue a registered notice to the power agent intimating or decision to cancel the power of attorney deed executed in his favor with immediate forthwith and instruct him to not proceed with any act related to the property issue through this POA deed anymore and any such act from the date of this registered notice shall be deemed to be invalid and illegal and not binding on you.

You can publish the same in a local newspaper also as a public notice to caution the general public to not to indulge in any such activity on the basis of this GPA in future.

After all these, you may execute a registered cancellation deed cancelling the registered power of attorney deed.
