• Service of summons

I have tried sending the divorce notice to my husband through the court but he has been evading it. I have collected the hand notice from the court. Is it possible for me, being the petitioner, to Serve the hand summons to him personally? Will the court accept it?

Dear Madam, you will take hand summons from the court to serve on the said Respondent husband on the basis of court order f, you will take also help of your lawyer they will do it proper channel on his own strategies, eventhough your husband will avoid the summons, you will take substitute service through paper publication as per law.

Dear Querist

on the date fixed or before the date of the case, file an application before the Family Court U/s 10(3) of Family Courts Act-1984, for issue a Dasti Order of Summon and take the dasti order of Summon and served on him personally, the court shall accept this way.

apart from this if he is evading the service of summon you may approach to court for publication of summon Under Order 5 rule 20 of CPC read with section 10(3) of Family Courts Act-1984.

Even if you go to serve him the summons personally he may refuse to accept it, so better apply to the court to serve the summons through a registered post. The acknowledgment will return to the court regardless of whether he accepts it or not.

The hand summons are also to be served through court process only or by private service by courier or registered post.
