• Harassment by ex wife and how to prevent and be protected

After a long and harrowing experience of going through false cases under 498A and DP Act, I was acquitted conclusively by courts. In view of above, I wanted Divorce and after one and half decades of delays caused by ex wife, court clearly gave a decree order on grounds of desertion and cruelty. This happened nearly 4 years ago and the period of limitation is over.
For the past several months, ex wife has been calling on my mobile number and spreading misinformation, writing abusive mails to my official mail id, writing bad mails to my office colleagues to defame, trying to extort money and still calling herself as my wife.
I do not know what to do to act against this person, and also to prevent her from such terrible acts in future.
I do not see any interest from police taking up cases of this nature when they are already busy with other bigger issues.
Can someone help me quickly as the harassment is getting worse by the day?

Immediately file a civil suit for mandatory injunction and defamation suit against her before civil court along with an application for temporary injunction under Order 39 rule 1&2 of CPC.

The court may pass an injunction order against her and restraint her to do any illegal threats or activities towards you.

If after injunction order she is not ready to stop these type of nonsense then you may file a contempt of court proceedings against her, as you are divorcee and the marriage has been dissolved then she has no right to send this type of mail.

You may claim compensation from her for your damages.

1. These are pure acts of intimidation for which you can file case of criminal intimidation u/s506 IPC.

2.These are stalking and defamation alos for which you can also file case u/s 500,503 ipc.

3. Since these are non conginzable offence the Police will not register FIR but you can file complaint case in court u/s 200 crpc r/w 2(d) of crpc.

4. This is also criminal case for which summons is issued and the accused person has to take bail.

1. You have lots of potent remedies under the legal framework to put an end to this. You may immediately file a suit for injunction to restrain her from defaming you in any direct or indirect manner. The court can pass interim orders even on the first hearing.

2. Furthermore, you may also launch a criminal prosecution of your ex-spouse for the offence of defamation in addition to claiming damages from her.

3. Issue a lawyer's notice to her before going to court.

Prevention is better than quire. If you are not seek a remedy from police then avoid the phone calls of her (May it be in reject list / change Sim ) . Send a legal notice against her under the ground defamation. And also file a private complaint (Defamation suit )

against her in Judicial first calls magistrate court.

Whenever you think to file a police complaint, then all the photocopies of relevant documents (Divorce order, acquittal order) must be attached.
