• Name change post adoption

Hello, 
We have recently adopted a 1 year old girl through the CARA system. We have also received an adoption order by the honourable court a month back. The order mentions the child's birth name. We want to change the name of the girl now. Please advise us how to go about this.

Published the same in two news paper and official gazette and mention the new name of child in her documents.

You can make an affidavit with her new name and photos.

The said affidavit will have to be done through Magistrate .

Thereafter make a paper publication with her photo.

Except this nothing could be done .

File an application before the court under section 151 of CPC for issuance of certificate with the photo.

The court has power to issue the same.

1. adoption is called a new birth of the child adopted. so you can give any name of your choice.

2. you can file an ratification and correction application for issuance of adoption certificate in desired format like with photograph.

3) change of name has to be published in 2 local newspapers One in a major circulated English daily and another in any Vernacular daily of your choice.

The undermentioned circular issued by the government may be followed, the procedures mentioned in it for effective change of name in the birth certificate as desired.

The adoption order doesnt contain our photographs or the child's. This is listed as a mandatory document by the Passport Office for obtaining a passport for the child. How do we get this now, with the child's new name and photograph?

You can apply for a certified copy of the court order with the photograph affixed in it and duly signed with court seal on the photograph.

The court will certainly oblige, you can take the help of your advocate for this purpose.

1. Adoption under Hindu law is the complete transplantation of the adopted child in the adoptive parents family. So you are free to change the name of the child.

2. Apply to the court for amendment of the decree in order to bring the photographs of the child and adoptive parents on the record.
