Purchase of plot from builder, refuses to execute sale deed

I purcahsed a plot in the year 1987 from a builder. the property is situated at delhi up border i.e in up. i filed a case in civil court ghaziabad agnst builder. on my complaint an fir is also against him u/s 418/420 ipc. at ps ashok vihar delhi. in the civil suit i filed at ghaziabad builder accepts allotment, acceptance of money, development charges, exchange of letters,, but at the end of day cites quotes - he is not bound to execute sale deed since there is no registered or unregistered agreement between buyer and seller as per indian stamps act setions 17[2][5] applicable in the state of up wef 1.1.1977. actually builder at the time of booking promised to give agreement but had not given. this is in the complaint to p.s. delhi. in cross he says rate of plot was settled orally.[consider there were 280 plots]. there are other complainants too fighting legal battle at civil court ghaziabad and some are in fourms at delhi. please let me know how the section quoted above prevalent in the state of up is tackled with...
