Recovery of Lost/ theft Promissory Note

A gave some money to B by taking the B's signatures on a Promissory Note. A has died with surviving wife and daughter (C). Post that C was in Quarantine (in her in-laws house) due to corona & A's wife was in depression of her husband's death; Taking this as advantage, Another person (D) came to A's house and took the Promissory notes and other properties in the house. D has collected money from B and gave the original pronote to B but that money is not given neither to A's widow nor to D. Later, A's widow also died, leaving D as the only legal heir. A's Daughter-C has filed an FIR (IPC-420, 406, etc.,) in respective P.S; C has also filed the civil suite on B for recovery of suite money (included D as the Defendant-2 in the suite). C has submitted the FIR as the evidence (It is marked) and submitted the Xerox copy of the lost promissory note (It was taken by C in their house, after the death of A and before D theft it_Date & Time of Photo available; As original Promissory note is lost). Court is not marking the Xerox copy. Can someone suggest any provision, Reference case law. etc., under which the Promissory note's Xerox copy can be Marked and C can get the justice ? NOTE: B did not attend the court proceedings. so, it is given as Exparte.
