Complications after bayana is given

Hello. Last year, in the month of December, my father had sold a piece of land to a person and had taken 10 lakhs as bayana. All the details regarding the property is mentioned in the documents and it was agreed upon by the buyer before he had signed the documents and given bayana. The buyer was given time until this year's may 30 to pay the entire sum. Now, when almost one month is left to pay the entire sum, the buyer is backing out and claiming false allegations. One of his allegations is that the property is not of the same area ( in square feet) as mentioned in the bayana. Although the property was measured right infront of him to avoid any such problems in future and he completely agreed with it. Despite that, this problem has arrived. Although it is mentioned in the bayana that the token money will be forfeited if the buyer backs out. I want to know if there is any chance of token money being taken from my father ( seller) back by the buyer upon his false claims. Please let me know of the same asap! Thank you so much .
