NOC to be issued directly to the Bank

One of our member wants to sell his flat The buyer intends to take loan from the Bank . Member has sent us the Banks format for NOC . This letter is addressed directly to the bank and not to the member . We have already given No Dues letter to the Member . Are we obliged to give such letter directly to the bank even the contents in the letter cannot be fulfilled by the Society . Example the letter says "We hereby assure you that the said flat, as well as the said building and the land appurtenant thereto are not subject to any encumbrance, charge or liability of any kind whatsoever and that the entire property is free and marketable. We further confirm that we have a clear, legal and marketable title to the said property and every part thereof" In our case we have a land dispute with the neighbouring land owner and case is in court , We cannot give above remarks in our letter as this is a false statement So our committee refused to give this letter to the member . Member is after us to get the letter from us . What is the solution ?
