NCLT ordered insolvency resolution process against the builder post our flat registration

We’d booked a flat with a builder (GM infinite – Gulam Mustafa enterprises pvt ltd). It was supposed to be delivered by Aug 2021, but it hasn’t been delivered so far. Recently, last month on Feb 24, we got our flat registered. However, the builder must complete the pending work before they provide us with the possession. In the meantime, we learnt that NCLT has passed on an order on 29th Feb 24 against GM enterprises as one of their suppliers had approached NCLT. The NCLT ordered the commencement of a corporate insolvency resolution process of Gulam Mustafa Enterprises Pvt Ltd. The public announcement was notified on 3rd Mar. On 10th Mar, Interim resolution professional (IRP) requested all home buyers to submit “Form CA” furnishing all the details for the claim. He insisted we furnish the total amount paid including the interest charges if possession is delayed. On 11th Mar, we learnt that GM enterprises has applied a writ petition against NCLT order in High court. As per them, petition was accepted and a stay was issued by High court. And the builder’s team is saying they’re challenging NCLT order in High Court and will continue to complete the project in coming months. My query: 1. We as home buyers would like to get our flats rather than the amount refunded. 2. We aren’t sure if we furnish all the details by submitting “Form CA” then does it mean we’re claiming our rights on the flat or claiming the amount to be refunded in place of flat. 3. If we don’t submit the claim by submitting form CA now, does it lead to major hurdles or challenges later. Kindly guide me on the best course of action so that we get possession of our registered flat.
