Builders not forming the society.

I am from Belgaum(Karnataka). we have purchased a flat in an apartment in the year 2005. when we moved into the apartment, we noticed 1. The terrace which comes under common area for all the owners of the property is been partioned by the builder and the one of the previous owners who had given their land for the development of the project has locked in the portion of the terrace and made it private . 2. The portion of the parking area that was been alloted in the building plan is been violated and constructed a flat by the builder and made a sale of that flat to one of the existing owners of the property. 3. when asked for the clarification the builder said that it is his will as he has the ownership of the property and none of the owners of the appartment can question regarding what he has sold . And he asked to give NOC that we do not have any problem to the flat that is constructed illegaly. 4. The builder asked everyone to come and form society or association and it is not his obligation to do it . 5. now it is been 18 years, that out of 11 approved flats owners, only 5 of them are ready for the making of the society registration . But rest of the flat owners are not ready for the formation due to the apprehensions that they have because of they would stop enjoying the personal benefits from it. 6. now also can we go ahead for the formation of society registration ? 7. all these years we kept trying but there is non cooperation from all the flat owners. so, now that we 5 flat owners have come together can we move ahead with it? 8. please suggest according which registration act we need to move ahead for it. ? 9. what will be the documents required for the registration in karnataka belgaum? 10. what will be the fees structure for the documents to prepare?
