Refund from Builder

Hi Sir, I wanted to purchase a property in pre-launch and got in touch with a builder. I have taken decision to make a purchase and finalized 45L as the total price and paid 11L in advance. Later, I got to know that he is merely a marketing person where he acquires land from land owners and get Gram panchayat permissions and gives contract to other builder who actually construct the home. After paying 11L in around 5 instalments during Jan 2022 and May 2022, the builder has not registered the land on my name after which he is going to construct the house. Neither he made any agreement of sale and used delay tactics to delay sale agreement till Feb 2024. When I have confronted him hardly, he says he got in problems with land owners and needs 20L more to construct the house or he returns the money with interest (18%). While he says that, I have lost trust on the builder as he didn't even make sale agreement. All I have is payment receipt from the builder for 11L and xerox copy of booking form (application form of the company) on which I have signed not the builder. What are the options do I have now ? 1. Are payment receipts from the builder sufficient to issue a legal notice and then file a consumer complaint if he doesn't respond to it. 2. Should I get into an agreement first, where I clearly call out the inability of the builder to give Possession and on goodwill, builder is going to return my money along with interest. While I have to find out if builder does point 2, where I would delay my legal notice. All I wanted to understand is, if I'm in control of the situation or in a tricky place?
