Under property law

My friends grandfather recently buy the building with 3 floors not including groundfloor he has 2 sons 2 daughters he decided that in that 3 floor including groundfloor the sons and daughters should only stay not other like third parties he don't wish to rent his house his last sons don't like to stay in the 3rd floor because a family issue so he went to rental house now that son is trying that 3rd floor to leave in rent but this father don't want to leave the house in rent the house is his own property which I mentioned he buy recently the property is also in his name till now but that last son's wife which she is taking step to leave the 3rd floor rent even that son is accepting it now my question is that the son can leave the 3rd floor rent but the property is in that father's name can that last son put case something for this house like only for 1 floor whether the case can exist in the court or the father should divide the property equally to all the sons and daughters now also I'm mentioning that the property is in his name and this is not a property which exists from his forefathers living he just recently bought this property please anybody tell me that if he puts case means for his father property that case will be valid or not
