Refund on token money without entering into the rent agreement

Date : Jan 18, 2024 Hi, We are living in bangalore and recently planned to shift from our current place. We gave a token of 50k to the owner (Jan 9th) to start residing from Feb 1. Flat rent: 50k excluding maintenance. Maintenance: 4.5 k Deposit:2.25 lacs Brokerage: 50k (out of which we paid 25k to the broker and remaining to be paid once we move in) The owner shared the agreement draft on 9th. On Jan 13th, I asked owner to discuss some concerns in the agreement. The owner has clause to deduct 1 month rent for painting, when the tenant vacates the flat and 10% rent increase for the next year. The concern is that owner has also mentioned a clause to have a lock-in of 10 months, which means if we vacate the house before 10 months, he will charge 1 month rent extra. So in total if we leave the house before 10 months, he will deduct 2 months rent from the deposit. He did not inform us about this lock-in period before accepting the token, and we saw it only in the agreement draft. We don't find this lock-in ethical and since we are not fully aware of the pros and cons of that area, we decided not to go ahead with the agreement. He is now not refunding the token. I have asked him to deduct the token on pro- rata basis ( from the date he shared the agreement to the date we shared our concerns i.e. 5 days)but he didn't agree. Please guide the correct way to proceed to get the refund of token amount. Thanks.
