Protect my parents, family and our self-acquired home from son and daughter-in-law & her family • My brother and his wife have been having dispute with my father and us since the last few years but lately it has increase dramatically. • My brother has been threatening to leave the house since the last couple of years and few months back my father asked him to leave but he has not done yet and continues to quarrel with him along with his wife. My father has disowned him (though verbally and not legally) but they continue to stay with us. • My father 69 has lately had a major surgery(Cancer) done and yet to recover from the truma but my brother continues to push him to give his share of property and the money he himself had borrowed from his in-laws when he was actively working in the company (2015) • Our financial situation has in unwell and post operation of my father things have become worse. Financially we were left with a big debt when my brother left the company to start his own in the year 2020. • Since, we started our own new business and have been servicing the loan interest, which my brother has not contributed at all since 2020. • But now he they want a stake in the assets (whatever is left) and not participate in the much higher loans. • My fear is that my brother, his wife and in-laws can file false cases against us and implicate in false cases under 498a, 120 against my parents and us as counter attack. • Now I want to protect my father from current mental harassment and also the property that he has acquired over the period. Questions 1. To evict her from the property, some lawyer suggests to file mandatory injection suit, some suggest senior citizen act and others suggest permanent injunction suit, which will be the fast and sure option? 2. My father and other family members fear of false cases, and harassments? 3. Further we are not aware of good lawyers and given our financial situation cannot afford much as the fees charged by lawyers are high.
