Recruited for vacancies arose on or before 01.01.2004 - regarding

Respected lawyers, i wish to submit the following lines for your consideration 1. I was recruited for a vacancy occurred before 22.12.2003 for which examination notified on jan 2004 and conducted on feb 2004. 2. the vacancies were approved by the ministry on October 2003 and were notified along with Recruitment rules on 23.12.2003. let me brief the orders of Govt regarding conversion NPS to OPS. 1. OM dated 17.02.2020, "such government servants who were declared successful for recruitmtnet in the results declared on or before 31.12.2003 against vacancies occurring before 01.01.2004 and are covered under NPS on joining service on or after 01.01.2004, may be given a one-time option to be covered under the CCS(Pension) Rules, 1972 2. OM dated 03.03.2023, "who has been appointed against a post or vacancy which was advertised/notified for recruitment/appointment, prior to the date of notification for National Pension System i.e. 22nd December 2003, may be given a one-time option to be covered under the CCS(Pension) Rules, 1972 3. in the OM dated 17.02.2020, it was mentioned "vacancies occurring before 01.01.2004" and the cut off date was 01.01.2004. In the OM dated 03.03.2003, it was mentioned as a post or vacancy which was advertised/notified for recruitment/appointment, prior to the date of notification for National Pension System i.e. 22.12.2003. 4. As per the Ernakulam CAT judgement which was stayed by the Kerala HC, the emoloyees recruited against a vacancy arose on or before 01.01.2004, are eligible under OPS. The appeals is still pending before Kerala HC. And, some CAT judgements are favour of Vacancy Year. 5. Recently, Madras HC observed in the case of Vallipavai that the recruitment process starts from the approval of the vacancy.
