Refund money from Builder in case of Cancellation

Hello, I want to know my rights. i had booked a flat in a pre launch in Sep,2013 in Grater Noida, Gautam Budh Nagar, Uttar Pradesh. Builder has launched this project in Mar, 2014 and released allotment letter. After reading allotment letter, there were many clauses which were one sided and i was not ready to sign the BBA. i was assured by builder to amend these but they kept on delaying it. At the same time, i continue to pay the demands raised by builder to avoid any late penalty and delay penalty in future. later, i moved to some other city and continue to pay all demands on time. Now builder has offered the possession and ready to pay delay possession penalty at 8.3% at MCLR rate. i want to know as i am yet to sign BBA 1. can i ask builder to pay 12% delay possession penalty as per RERA? 2. can i ask builder to cancel my allotment and refund my deposit amount at MCLR 8.3% rate? 3. what if builder refuse to accept any one of above points. can i still approach RERA as i have not signed BBA?
