Who does the road within a colony belong to?

We are a small colony of around 25 families. The owner of this field sold plots to us first and constructed the houses themselves. The common street/ gully between/ connecting houses is around 10 feet. My issue is that the drain/ gutter they have made throughout the colony is not levelled properly because of which the drain adjacent to the front of my house gets filled up either during rainfall or if the other residents discard large amount of water. Each of the drain outlet from every house falls right into the gutter resulting in the gutter water entering my drain outlet and filling up my washroom inside my house. As a temporary solution, I put a drain pipe cap every time it rains or if I see the gutter filling up. I have requested the owner who sold the plots to cutout a drain outlet from my house towards the next gutter which is properly sloped so that the gutter drains out much easily. I have even told him that I shall bear all the construction cost. But he has been ignoring my pleas since 4 months. He has a handful of personal labors and technicians whom he engages whenever/ wherever any one requires within the colony. He is neither employing his labors for my work nor he is allowing me to get some other labourers from outside the colony. For somebody having to get her hands inside the drain and put/ remove the pipe cap almost 4-5 times a day, I am really started to get frustrated and don't know how to solve this issue. Do I need to get this issue legally solved? Please guide.
