I had paid Rs.3 lakhs to my neighbor as an advance for purchasing agricultural land from him. Later I found that the property had issues related to documents and hence I cancelled the agreement in accordance with the agreement. However, I did not know that I had to take witnesses for this 'cancellation'. Years passed and finally he gave a post-dated cheque to return my amount. As expected, the cheque bounced and I filed a legal case. He has been fighting very strongly on this case and for no reason my case stands weak. This is because I have lost 3 lakhs to him, lost some 20 thousand on legal fees. On both sides, I have lost money now I dont have money to continue the case, and my lawyers are not at all helpful. For this reason, the accused's case stands strong and they also did cross-questioning on me 3 times. We have never done anything, except for getting new 'dates' every time I go to court. I have attended 51 times till now, but the accused has done only 4 or 5 times in the last 4 years. Do you think I will lose this case and go to jail, as the accused has also done a false charge on me - complained to judge that I have done a forgery sign on cancellation of agreement. As my lawyers are not supporting me, not sure what all allegations he has made against me and how far they have been successful in convincing the judge. Or do you think I will win the case, as it is crystal clear from the Bank endorsement that his cheque was bounced due to lack of funds. Moreover, I have all other documents like agreement, hand written cancellation with his signature etc.
