Can a Bangalore Development Authority(BDA) corner auction site Bifurcated and soled

Hi Sir, Iam planning to buy a BDA site from one seller. He has purchased this site from one person who had bought this site from BDA through auction some 30years back. The original size of corner site was 60x35, BDA has executed a sale deed in the name of ordinal buyer in 2003 and the layout is now maintained by BBMP/corporation, the khatha etc is transferred. the original buyer, recently a year back got it bifurcated into 2 sites(30x35 size each), kept a site with him and has constructed a house and other portion(vacant site) he has soled to present owner. The present owner is selling the vacant portion to me. He has taken loan from cannara bank. In the Auction certificate which was issued to original buyer when it was auctioned, BDA has mentioned the corner site should be used as single unit and should not be bifurcated in any conditions. Is it ok to buy this site?. Present owner says since its already transferred from BDA to BBMP/corporation and the bifurcation is approved/done by BBMP, BDA rules will not be applicable. Will i face any legall issues later. Please suggest. Thanks
