Society maintenance charges

My partners signed a sale agreement with a builder in 2007 without informing me. I came to know about it after two yrs and filed a suit against them in 2009.My lawyer was hand in glove with their lawyers and he filed a partition suit instead of dissolution of partnership and the result was that Dharmadhikari reserved 3 flats for me and ordered defendants not to sell the flats. The order is of 8th Oct. 2010 and a 17 storey building has been constructed on the site which got completion & OC certificates in 2013.The builder handed over 18 flats to our firm as per the agreement which also included 3 flats of my share. Since then, these 3 flats are lying vacant in the name of our firm and the society is going on imposing maintenance bills for them. In these 8 yrs the bills have amounted to 25 lacs and now they have sent me a notice to clear the amount with interest or else they will file suit 101 at deputy registrar's office for sale of all 3 flats. Now, my question is, can they charge maintenance on vacant, unsold and unpossessed flats. If yes then who will pay for flats reserved in the high court?
