Buying resale property from an NRI

Dear all, I find myself in a bit of a desperate situation where I'm intending to buy a resale property in Pune from an NRI (US citizen). This deal was initiated in Nov 2019 when I paid a token amount to the owner and also signed an MoU, which has long expired. The reason this deal has taken this long is the owner has applied for a lower TDS certificate which he has still not received and we also lost a few months due to the pandemic. Now, however, I need to either get the deal executed or get out of it as I had sold a property a couple of years back and need to re-invest that amount in property else I will be liable to pay LTCG in Mar this year. So, kindly advise on the below 2 points: 1. While I've confirmed with the owner over email if he will be willing to pay TDS at applicable rate in case he does not receive the certificate by the Feb-end, to which he has agreed. But how can I ensure this deal goes through in time as I'm not sure if his email commitment is sufficient? 2. Or how can I exit this deal without any further monetary damage? Do I stand to lose my token money? Thank you in advance!
