Limitation of act

House at Bangalore has been partitioned into half between my fathers's younger brother n my father. It was in the name of my father's elder brother. Before partition my father's elder brother has made will to my father's younger brother which is a forged will made by my father's younger brother n has not informed about this while partition was done. Now he claims that the full house belongs to him. My father had filed suit n got injection, but it was squashed in 2010 n court asked the parties to file appeal in trial court but as my father was unwell he had not filed the suit. Now in 2016, we could file the suit but it was rejected due to time barred for delay in filing the suit after 5 years. We have submitted medical certificate but court was not convinced. As my father is 85 years old, he doesn't remember the things n we are finding it difficult to handle the case as we doesn't know about the suits previously filed. Now my father's younger brother has changed khata to his name n filed suit for possession of our portion. My father has five daughters. We daughters are struggling to retain the partioned portion of house given to our father by unregistered palupatti. Pl suggest what can be done.
