The property in Maharashtra was jointly held in mother and fathers name and was their self-earned ,not ancestral.After demise of father without any will, mother, myself,Married sister and my elder brother - 4 are legal heirs. We have relinquished our rights in Mothers favour but the said deed was only notarised and not registered or paid of any stamp duty. Elder brother has been deserted by his wife after his marriage, 14 years ago, she is not living with him since then nor any more traceable. Brother has not got legal divorce though we insisted,hence his wifes rights are still intact,if the property or part of it is gifted or earmarked to him. In addition,he does nothing for daily wages and gets fed on Mothers Pension. He is only waiting for his share to get conferred through Will or sort of Cash settlement..As such Rest of us incl.Mother find him Financially imprudent and Non-Deserving to get any property .On depriving him of any material transfer but Just to ensure his daily bread and bare necessities to be duly taken care of, Mother wants Brother to continue living under shelter of Our Native home (Marked as a gift to my son after my Brothers demise only) without any right to sell or make encumbrances over it and she wishes me to arrange him Monthly Pension out of her MF money through SWP . My Children will be major beneficiary in her will. How can it be drafted and executed legally ?
