Pay protection on technical resignation

Dear Sir, I have given technical resignation from one department and joined another place through competitive exams in the same department and same post after completing 13 months of service. Shall i get benefits of technical resignation which includes Pay protection, I have followed all the guidelines mentioned in the O.M no. 28020/1/2010 Estt.(C) dated on 17/08/2016. ie; All the application forwarded through proper channel only. Probation period was not completed but my post is substantive not ad hoc and declared before application NOC obtained before online application for the post I have intimated my technical resignation immediately after joining etc. (The final reason behind the denial of these benefits application stated by present employer is that you have not holds that post substantively). But the post i joined is substantive, i think there is misunderstanding of interpretation of word "substantive". It is about the post not the posting. So kindly please provide your legal opinion in this matter.
