Partition Deed Vs Settlement Deed

My father had purchased immovable properties jointly along with his two brothers through the registered Sale Deed. My father will get an undivided 1/3rd share in the above-said property. But my father and his two brothers did not partition the above property till now... After the demise of my father, I and my three brothers have partitioned my father's undivided 1/3 rd share of the above property and the Partition Deed was executed and the same has been presented before the Sub Registrar in Andhra Pradesh Stated. The Sub Registrar kept the document pending and the same was sent to the District Registrar for clarification seeking whether the stamp duty chargeable on Partition or Settlement Deed... The District Registrar had clarified that this deed shall be paid stamp duty as Settlement Deed for the reason that we partitioned undivided share... Please Clarify whether this Deed will be paid Stamp Duty as Partition Deed or Settlement Deed... Please specify Acts, Rules and Court Judgements if any... Thank You .. Sanjay Bandi
