Refund in case of cancellation due to pandemic situation like COVID

During my first visit to builder office, I liked d property and paid Rs. 41000 to show interest in property and to get the best quotation. I signed the enquiry and booking application form without going deep in terms and conditions. Builder offered me 14th floor and ask for 5% payment within 1 month, after 2 months when I go to builder he said 14th floor is sold , now we have 10th floor available. Just not to avoid best rate offered as claimed by sales managers , I said ok but ask builder to allocate me upper flower and paid 2.5% ONLY but never signed any document for 10th floor. Within one month I.e. March due to corona pandemic came now I don't want to continue deal due financial crisis. I asked builder to cancel but he is saying the paid amount rs 3 lacs is not refundable. I read terms and conditions, it's been said cancellation charges are 10% of agreement value so builder is saying your amount is forfietied. I do not understand legally what is token or kindness value, which is refundable or not but somehow I feel I m in crisis of losing money So how I should talk to builder to get my money back. Please advise
