Registration of Special power of attorney for executing Gift Deed.

My relative who has been staying in the USA since 1983, and I had jointly booked a flat in 2004. In 2008 this relative appointed mu uncle with special power of attorney powers without my knowledge. In 2008 my uncle took advantage of my personal family problems and got me to sign Gift Deed papers. This gift deed was later registered and my name removed from Society share certificate. My relative has now filed an eviction case in court in 2015 (ongoing case). In this case, my relative has produced the Special power of attorney document ( I saw this for the first time when case was filed) granted to my uncle for executing Gift Deed. The special power of attorney document dated 2008 is notarised but is not registered. 1. My question is ' Is this SPA document legally valid since it is not registered. 2. In this document there is no mention of the fact that my relative is a US citizen. 3.Under these circumstances is my uncle eligible to execute Gift Deed ? Addl. points: 1. I have been in possession of this flat since possession was given in 2007 first given and have been paying all outgoings viz. Maintenance, Electricity, gas, Internet, etc. 2. My uncle has since expired in 2013. 3. my uncle was appointed by my relative, the donee in this case,without my knowledge. 4. I was not informedorally oriin writing that my name has been removed from Share Certificate. earlier Share certificate showed joint ownership with my relative. Regards and Thank you. Khadim Kapadia
