We have purchased a flat in Navi Mumbai. Between me (Purchaser) and Owner there were two different agents from different agencies were involved. During our agreement , the NOC amount which was 30k I.e.15k buyer and 15k from the seller was to be paid. The seller asked us to pay 15k of his part of the NOC amount to the society for now, and he promised to give 15000 later on. We paid the whole 30k through cheque. After the completion of the process, he says he has given his15000 Rs. to his Agent and asking us to take it from him. But when we contacted their agent, he is denying to give as he is saying that we have made an rent agreement with existing tenant without informing him and is not ready to return our amount of 15k. No where during the whole purchase process we were informed that the tenants were arranged by the sellers agent. Its was only after 20 days the sellers agent suddenly contacted and said it is his tenant and ask the tenant to the pay the brokerage money. He is threatening us to ask the tenant to vacate or I will not return the money. The tenants wife being pregnant and her due date being closer , we do not expect to vacate them When we informed this to seller, that our deal was with you to return the 15k which you should return. He is saying he has completed his deal and paid the money to his agent and you follow up with him. We do not know his agent and neither did we deal with him before and when asking him to return money, he is not ready to. So we wanted to take guidance, on how to move forward on this. Should we file a police complaint.. and should file a complaint against both the seller and their agent.. Or is there any other approach.
