I was planning to purchase a duplex in bhubaneswar. I have fixed one property and the agent has told me that the project has not been approved by bda yet however we had applied for the same and will get approved by one month time so the agent demanded me 5 lacs .that time I did not have cheque with me so I had given 5lacs cheque of my brother but he has issued receipt in favour of me. time passed after 3 month also they did not have bda approval so I asked him to return my money .upon my demand he told me that he is having another project he can me a plot from that project then I said ok. again 10 months passed he was not able to give the new ploat then I started demanding my money back in the mean time he has returned me 4 lacs out of 5 lacs in return he has taken the 5 lacs receipt and given one lacs receipt. after some days he told me that the remaining one lacs he has paid to builder and given a one lac checqe . the cheque bounced and the agent as well as builder are not picking the phone .I am doing job in Mumbai and the case happened in bhubaneswar it is very difficult for me to physically present in bhubaneswar to demand money now neither the agent nor the builder picking my phone I need advice on below points. 1.can I file 420 againest the agent .if so will it create any issue because of my brother has paid the cheque and receipt in my name. 2.can I go to consumer court againest agent. 3.can I file a cheque bounce case againest builder .it is to inform you that I have not done any transactions directly with builder 4.I was thinking that I am ok if they will return my principal only but now I want interest with principal along with mental agony and legal fees. 5.who has to file case me or my brother. need advice how to proceed
