Refund of token amount

Dear Sir or Madam, I have deposited 1 lakh as a token amount through cheque to a builder in Noida Ext.(Greater Noida west) However due to some unavoidable circumstances I had to cancel the deal, before depositing the 10% booking amount. 1 lakh cheque was cleared on 7th Oct, and today is 15th Oct. While asking for refund, the builder is deducting 50k+GST, which is a huge amount. In the application form it is written as: "I/We, the applicant (s) do hereby declare that my/our application for allotment of a unit is irrevocable and that the above particulars/information/details given by me/us are true and correct and no material fact has been concealed there from. In case of any false or misleading information provided by the applicant (s), the company shall be entitled to forfeit the amount deposited by the Applicant (s) as per the rules and regulation of the company." However in my understanding this is applicable only when 10% of base price is paid and flat is formally booked
