OP want to compromise but in Sec 11 of HMA ..DOM is disputed . How to proceed for divorce ?
Party A ( girls side)
Party B ( boys side) .
B wants to settle disputes with A , But instead of 13b mutual consent of HMA 1955, B wants to get it done in nullity decree sec 11 filed by him .
Is it possible ??? bcoz date of marriage is disputed between both A & B .
Solution given by B -
B will File a compromise in 482 High court for all pending cases to be quashed & as per him settlement will be done on the basis of compromise where A has to agree on B's date of marriage through compromise deed & then lower court will grant nullity decree. whereas high court will quash all criminal cases
My Question is -
1) Wouldn't it be a contempt on A's part as in lower courts A has already mentioned date of marriage according to them which is a matter of dispute .
2) How to resolve this matter as B is not willing to go for 13 B ....but is adamant to take decree u/s 11
3) Can in lower court a settlement deed given where it is mentioned A is agreeing on B's date but it is not admission only on the basis of compromise and then they can take nullity decree under sec 11
List of cases filed by B - 494 & 420 , 482 pending to quash 498a , sec 11 of HMA
List of cases by A - Sec 9 ( RCR) , 125 , 498a , 504,506 , 323
