Neelam Kumari Vs. Ritu Bala & ors.
Present: Sh. A.S Gill Advocate counsel for plaintiff.
Suit received by entrustment. Report of reader perused. It be registered.
Plaintiff at this stage presses for exparte ad-interim Injunction. Plaintiff
Neelam Kumari alleges that she purchased the suit property vide registered sale deed dated
25.03.2002 from Vinod Kumar s/o Chaman Lal. It is pleaded that defendants by
impersonating plaintiff Neelam Kumari got land measuring 39 Kanals 16 marlas sold in
favour of defendant no. 3 to 5 vide sale deed dated 16.03.2006, further 39 Kanal 6 marlas
vide sale deed 16.03.2006 in favour of defendant no. 1 and 2, another sale deed dated
16.03.2006 of 19 kanal 17 marlas in favour of defendant no. 6, another sale deed dated
23.02.2007 of 19 kanal 17.5 marlas in favour of defendant no. 7. It is alleged that plaintiff
never executed these sale deeds in favour of defendants. It is alleged that photograph of
Neelam kumari on the said sale deeds does not match with plaintiff Neelam Kumari.
Plaintiff counsel further states that enquiry by SP Pathankot is pending and the whole fraud
will be revealed. It is pleaded till further orders the alienation by defendants be stayed.
Plaintiff is categorically stating that she never executed the alleged sale deeds
in favour of defendants. It is further pleaded that said sale deeds are acts of impersonation.
The investigation by police is pending. Till the other party files their reply it is necessary
that creation of third party interests be avoided. As such defendants are restrained from
making alienation/ mortgaging or creating any third party interest in the suit land on the
basis of their claim as per sale deeds dated 16.03.2006 and 23.02.2007 detailed above, till
further orders. Copy of this order be placed by plaintiff before concerned Patwari who will
make the necessary entry of this order in the revenue record.
Let notice of the suit and this order be issued to defendants for 21.09.2019 on
filing of PF and copy of plaint and stay application. Plaintiff is directed to comply with the
order U/o 39 Rule 3 within 24 hours.
