Resettlement or sale deed??

In 1963 in our family settlement,My father (-J -)gets his self earned grandfather property at 11 years of age,which at time his brother(-B-) was not born..In 2010,my father -J- gives 50 percent of his share in both land & building to- B- (has one daughter)in the northern part in a settlement deed,without our(2 sons) knowledge..Now in 2015 with their respective money they demolish & reconstruct the house for which they acquire 40 lakh loan from bank with-B-as the primary applicant & -J-as the co-applicant.THE -B- MISAPPROPRIATES MONEY & RIGHTS TO A HIGH EXTENT IN ALL POSSIBLE WAYS,for -J- family lived in another city & -J-only coexisted with -B-family..NOW THE -B- gets unaccountable for the money laundered & in own family & blood relationship arbitration,-B-decides to sell his property again to his elder brother -J- & family...NOW currently,-J-& his 2 sons takes a position to preclose the bank loan, retrieve the document from bank & pay the balance quoted money to -B- to buy the property back from B will & concern.NOW WHICH IS APPROPRIATE?? SETTLEMENT DEED FROM B to J --OR-- SALE DEED ..note: J is 65 years ,now living with both sons married & B IS 52 years old living with wife & one daughter unmarried..NOW THE NEW HOUSE HAS A GROUNGFLOOR CARPARKING AREA ALONG WITH 3 RENTED OFFICES,FIRST FLOOR WITH J FAMILY,& SECOND FLOOR WITH B FAMILY..& terrace..(both family not in good terms)...
