Want to do gift deed of my flat to my mother

I am planning to file divorce against cruility. I have a flat which I want to gift to my mother via gift deed before I file the divorce case. Will my wife or court can able to take objection during the divorce process that I did this purposely. Actually I have taken money from my mother for the flat & I am not able to repay her due to my financial issues. So before filling my own divorce case I want to do gift deed & want to give my home to my mother so that she will get her money back & at the same time my wife will not demand any share in my house. But my estate agent saying that do not do this otherwise there will be problem in future & court may take it against me. So he is suggesting me to sale the flat to my mother instead of giving the flat to my mother against gift deed. But problem is for gift deed it requires 4% stamp duty +1% registration charges +agent charge. And if I sale the flat then my mother needs to give me handsome money +it will create problem of income tax +7 % stamp duty +1% registration charges +agent charge. Pls suggest what should I do - gift deed or sale.. And if gift deed then will there any problem in future from my wife or by family court against it during filing /hearing if divorce case. Pls suggest
