Property inherited from GrandMother in joint names Father and Mother

A.GrandMother (paternal) made property Will in joint names of my Father / Mother. B. Property and mutated records were registered in Father's name.only. C. When Father died, Father's Will was destroyed by my Brother. Hence it can be considered as father died inestate. D. Brother managed transfer Society Shares in my Mother's name after 2/3 years of father's death. I think he managed to transfer through Probate but without obtaining my consent, by putting notice in newspaper only. E. Brother took Will from my mother to transfer property in his name or his son's name (grandson). F. Now Mother has died and Brother is in a process to transfer property in his name / his son's name (grandson). G. I feel that both the brothers should have equal claim in the property and not him alone just because he obtained will from my mother. Question: 1) Can this property be considered as Ancestral property since property is inherited from GrandMother and not GrandFather? 2) Will was in Joint names, but my Father died Inestate, so does my Mother alone has rights to be partial and transfer property in only one Son name and ignore another ?. 3) What immediate course of action do you suggest so that (i) I am not evicted by my brother from that property (ii) I immediately get equal share judgement from the court? (iii) Society should not transfer share cert in my brother name?
