There are several other lawns and ornamental trees are there but they don’t want to convert the open spaces next to their blocks . Already there are 2 cricket pitches and 40000 sqft club house with tennis, badminton, snookers courts are there and 2 children play area one open and one closed and 5 swimming pools, SPA etc and many other open spaces & amenities and 10000 sqft free space in CA Site . now the association wants to convert the park to play ground near our buildings only to (multi sports complex such as foot ball, basket ball court etc). our questions are here as follows :- According to Karnataka High Court S.G. Definition of Park and open spaces and Play field ( play ground/sports complex) is same or different? 2. For converting park and open spaces to play field Change of Land use is necessary / Approval from BDA/ BBMP is required or not? 3. The association want to uproot all the 100 trees and convert to play ground. It is important to note that in the whole project only in this approximately 25000 sqft of park the root directly goes in to the soil all the other lawns/ artificial park are just above the cement basement . to whom we should raise complaint?? The MC members are not circulating the minutes of meeting and they are trying to do illegally 4. According to Karnataka Park, Play field and open spaces Section 6. Prohibition of the use of parks, play-fields and open spaces in certain cases.- No park, play-field or open space specified in the list published under section 4 or section 5 shall be used for any purpose other than the purpose or 4 purposes for which it was used on the date of commencement of this Act in such area. Kindly clarify this point. Since it was promised by the builder as park and relinquished by the builder as park from date of commencement the intended usage is park. Can the association change the intended usage?? 5. Sudden changes of park to sports complex will raise so many issues such as nuisance, breaking of doors and windows and the park and open spaces is surrounded with many apartments and many children and senior citizens will be affected. Recently a pregnant women was hit by football.
