Questions on Pagdi property Property » Maharashtra Posted 21 Jan 2019 Question Chain My father has 4 brothers who own a building in mumbai,I bought apartment on the 4th floor of this building on pagdi and had to pay 33% to my uncles when the old tenant moved out 16 yrs ago. My father passed away 5 years back and I am now a coowner of this building Questions 1) What is My legal status on the 4th Floor Tenant Or Owner (Question answered) 2) Do i still need to pay rent for my apartment on 4th floor to my uncles (Question answered) 3) Do I need to pay my co-owner when I sell this apartment. (Question answered) Pagdi Property My apartment on the 4th floor is made up of total 4 rooms (637 sq ft) Plus passage (50sq ft)to the main door Plus passage (200 sq ft)to toilets and bathroom which are outside my 4 rooms and access only through locked door Plus got a terrace (225 sq ft)which has got temporary roof on the top access to which is only through my living room. My rent receipts reads rent on the 4th floor for 4 rooms Rs XYZ. The thing is that I solely occupy the entire 4th floor and is completely secured with a locked front door and a locked back door to the toilets and bathroom. Question 4) As a tenant when it comes to redevelopment a total of how many sq foots am I legally entitled to as my uncle says that you are only entitled to the total sq foot of the 4 rooms which is total of 637 sq foot. Since I am the only one in possession of the total 4th floor which is approximately 1100 sq that is taking into account 4 rooms+passage+terrace+back passage including bathroom and toilets. 5) If one of my uncles object not to sign a transfer of tenancy agreement on the point of sell of my 4th floor property even after offering to pay 33% of the sales proceeds what can I do. 6) Out of 5 owners of the building if one co-owner refuses to go ahead of redevelopment but has signed and the MOU has been registered with the government office under what circumstances can the redevelopment go ahead. The building is in a bad repair condition and have already received 5 final notices from MAHDA to either repair or redevelop but this one uncle says he has no money for repair which is Rs8Lakhs his share when total repair bill is Rs40 Lakhs. So bringing everything repairs/ redevelopment to complete halt for the last 5 to 8 years 7) My uncle who is a co-owner and who is one of the guys to sign my rent receipts has not signed my rent receipts for the last 2 years and so even after paying rent I don’t have my rent receipts what can I do? His argument is that I should get rid of the temparory roof (cement Tile roof) on my terrace which has been there for over 10 years. His argument is if redevelopment happens then I would claim extra FSI for that terrace in question. Please advise how to resolve this issue 8) Being a co-owner and a tenant do I have legal right to sublet my property on the 4th floor
