Validiy of property deal in jan 2019

BDA allotted property to Mrs. Tilakavathy in 1985 through allotment letter, lease and sale agreement, position certificate and BDA katha. Tilakavathy got building plan sanction and built two floor house . Tilakavathy applied for absolute sale deed from BDA in 2000, but BDA insted of doing registered absolute sale deed, just gave an endorsement stating to consider conditional sale as absolute deed. Tilakavathy then sold to Mrs Kathabai+2 through registered sale deed in 2001. In this sale deed there is no mention about the BDA endorsement or missing absolute sale deed from BDA to Tilakavathy. Kantabai+2 sold to Mr. Satishkumar+1 through registered sale deed in 2009. Satish kumar got loan approved from Bharat Co-op Bank , Mumbai. In this sale deed also there is no mention about BDA endorsement and BDA sale deed. Next Satishkumar i got BBMP katha on her name and paid property tax. Satiskumar+1 sold to Mr Guruprasad (represented by his father as GPA) in 2015. Guruprasad got bank loan approved from State Bank of Mysore, Lalbagh road, Bangalore. In this sale deed also there is no mention about BDA endorsement and BDA sale deed. Next Guruprasad got katha transfered on his name and paid property tax Now I , vijaykumar want to purchase from Guruprasad by clearing SBM loan and paying balance to Guruprasad. Since Guruprasad is working is California, registration has to completed by 12/Jan/2019. loan clearance, mortgague cancelation, registration . My advocate says he will not give clearance certificate with marketable title, unless seller get BDA absolute sale deed from BDA along with NOC from BDA to re establish the marketable title. Please clarity whether can I initiate the transaction with all legal formalities fulfilled.
