Apartment Cancellation

Hi, We had booked a flat in Provident Sunworth, Bangalore during April 2014. Initially they told the flat will be ready by June 2016 and took almost one and half year more to complete the project. We got an email from them during Jan 2018 telling the OC is ready. In between during 2015, one of the news channel aired a news the land is illegal etc but to all the customer a senior executive sent an email the case has been resolved and not to worry. Because of this we suffered to get the Home Loan and paid the processing fee twice. From the initial days, we are facing one or the other problem and not very happy with the provident. Finally they scheduled a date for registration i.e. on 31st August. When all the process got completed (taking photo etc), in the register office we got to know that the Khata is not linking online and registration is not possible. We followed up continuously but they are not able to resolve the issue. Since we were following up with them continuously through call, email etc, one of the senior mentioned as, If khatha is not linking it is not a problem and still you can register. they literally fooled us. Finally we decided to go for cancellation. As per the agreement, we have to pay 10% of the flat value plus the government levy which comes to totally 6-7 lacs. This is a huge loss to us plus we have paid interest on home loan from past 3 years. Bearing this loss is further more burden to us. Neither we got a flat on time, loss on cancellation etc. we requested the builder to give some discount or waive off some amount on that 10% but their are denying completely even the fault is from their end. Kindly help how to move forward. if we go to consumer court, will it be benefited. if the case prolongs we are not in a situation to bear the expenses. Please suggest.
