Tenant not paid rent for more than a year and not vacating the place

Dear Sir/Madam, We are from Bangalore, India and we own a 5 BHK house there which we have been giving out for rent for almost 4 years now. After the first tenant left, the second tenant moved in in two months time and started paying the rent very inconsistently and finally stopped paying the rent (26,000 INR) for almost 14 months now in spite of multiple follow ups and concerns raised. They kept promising but paid nothing. We finally gave him a warning and took from him in writing in a bond paper that he would vacate by Jan 2018 however he then shockingly filed a case on us stating we were unnecessarily forcing him to vacate. The case was then falsified by law in our favor. Now we have filed a case on the tenant as we have not been receiving rent till date and he has not vacated despite multiple promises. The case has dragged on for five hearings and the defendants have not appeared till now for cross examination. We have however completed our cross examination. Now the defendant is looking for another chance and we have one more hearing scheduled soon. We are not sure if they’ll appear or not appear but they have promised to appear (but we do not know). As per our understanding, if the defendant fails to appear three times, the case will be in our favor however in this case it is not moving forward and it is causing a lot of stress in the family with so much financial loss as well due to the house loan that we are paying without receipt of duly rents Please advise if this is a concern Thank you
