Bank Account Opening on Name Of Proposed Society & Formation of Society without Builders cooperatio

Requesting your guidance on below queries. It's been 3-years of completion received and people staying in society. As per maintenance collection term in agreement it is ended on October 2018. Builder in denial mode to form society, maintaining society, disclose on maintenance fund remained from collected 3-years maintenance i.e. 126000 x 84 Flats = 10,584,000 INR (2-flats haven't paid as per his claim). It is Phase -1 of building. 2nd Phase - not yet started and not sure when it will be. All amenities comes under 2nd phase. So cheated on amenities as not provide since last 3 years. Connecting road (Ease Of Access) which was told manually but not written in our agreement was never built since last 3-years though committed orally at time of sale. Q 1. Can we form a committee by calling meeting of owners and select designators i.e. Chairman\Secretory\Treasurer by passing resolution in that meeting with consent of present members. Q 2. Can we open an bank account on name of Proposed Society Name? And how it will be opened as it won't have any PAN number and Bank demand Society registration number or PAN Number of Society. Please guide. Purpose: If we get bank account we can begin collecting maintenance from owners, as well as some contribution to fund legal process against builder. Because the moment we start legal process builder will stop paying from our maintenance money which he collected. Q 3. Can we go ahead and register society without builders cooperation? How it will force builder to payback money still with him, do conveyance deed and transfer other desired rights i.e. ownership. requesting your guidance, thank you.
