Person is recovered after illness

Dear Sir, Hope all is well at your end. I want to discuss some matter with you. You know that 2 years ago we filled SMA in city court Karachi. Where my mother petitioner gave statement that my brother Najam Amin is mentally disable and prayed that his share will be given in her mother’s custody but Judge MA Channa ordered that her share will be submitted in court custody due to his mentally disability. Actually my brother is *not mentally disable* he is suffering from *schizophrenia*. By mistakenly we use the term *mentally disable*. He is much better now and maintaining himself shopping etc, knows his expenditures etc. *Now please legally advice that* 1. *Should I write application under secion 151 cpc in court on behalf of him that he is not mentally unfit he was suffering from schizophrenia and now he is recover and in good mentally health. 2. Should he engage lawyer by himself and state that I was depressed (shocked) due to the death of my father and was not in condition to appear in court for SMA. Now I am fully recovered. He will also further say that check my qualification and degrees and I am also maintaining bank account and also going to banks for cash and withdrawals on my signature. 3. Main point is that we had written in SMA that he is mentally disable and may be court takes action to us specially petitioner my mother that if a person was not lunatic then why you all give disinformation and misguide to court. Secondly I was searching on internet about judgment orders for schizophrenia patients I found Pakistan Supreme Court had ruled that “schizophrenia is not a mental disorder” On 21 October 2016 the Supreme Court of Pakistan turned down a plea to delay execution (by hanging) a person suffering from schizophrenia 1. The Supreme Court said schizophrenia was an “imbalance”, exacerbated by stress, that could be treated by drugs. The Supreme Court therefore determined that schizophrenia is “not a permanent mental disorder” 2. The Supreme Court hence concluded that it must be “a recoverable disease, which… does not fall within the definition of ‘mental disorder”. 3. “It is, therefore, a recoverable disease, which, in all the cases, does not fall within the definition of 'mental disorder',” the judges said in the verdict. But later But after report in media and verdict is outrageous by some doctors then Court allowed that if Imdad is deemed to have schizophrenia then his execution can be delayed until he has recovered.
