Termination of employment without prior notice

Hi All, I need to clarify in regards to recent event of termination of my services by my employer. I joined this organization on 15th May 2018 and still in probation period. I was suppose to get my salary of September 2018 on 7th Oct 2018. Since there was delay in salary credit, I preferred to have verbal communication with my reporting manager. There was no intimation of when I am suppose to get. So I preferred to write an email instead. After sending 4 chaser to them, there was no respond at all and all of sudden, I get an email from one of the Management person on 23rd Oct 2018 stating that either I will have to resign from my services or if they do not get my resignation I will be terminated effective 10th Nov 2018. Due to this act, I prefer to go as per the norms mentioned in my appointment letter wherein it is clearly mentioned either party can decide to leave the service by offering either one month notice period or in lieu of 1 month salary. Hence, the same has been replied to them asking for either 1 month notice period, clearling my previous dues or 1 month salary and clearing my previous dues. I simply need some suggestion if they do not go as per the norms, can I file a complaint accordingly to labour court? Thanks
