Tenant landlord eviction

Ours was a landlord property earlier named as suterwala chambers which was made ownership in 1990 by our accepting necessary payment from all tenants excepting one tenant who did not become a member due to the legal suit filed by us for eviction due to the alleged non payment of rent by him which he won and got tenancty right through the court and payment of rent of Rs.125/- p.m. as decided by the court till today. He has not been staying in my flat for which i had paid necessary payment that time and had become a member and owner of the flat in question. i refuse to accept his rent amount being sent by him regularly. i want to evict him on the grounds that he has not been staying for a long time and that my son is getting married and we are need of a separate house. the society has got recovery order in march 2018 from recovery officer for about 3.5 lakhs which was not paid by me as an owner of the flat from 2003 till now. i am in a fix as i have another flat admeasuring 350 sq.ft in the same society jointly owned by my wife, the 1st holder and me as a 2nd holder which i fear may be sealed due to nonpayment of my maintenance charges for above tenanted flat. the tenant is not agreeable to settle the matter. he just wants to release tenancy right with a small amount which is not acceptable to us. i seek advice from you as to what can be done. this is an urgent matter. Thank you. Huseini suterwala, grant road west.
