Hsg Coop Soc in Mumbai to charge flat owner Rs 20000/- besides the non occupancy charges.

Our Housing Cooperative Society has recently decided in an AGM to charge the members who have leased their flat Rs 20000/- per year even when they are charged the monthly non occupancy charges in their bill. Following is the extract of the relevant part of the minutes. quote To fix the policies in respect of flat given on leave and license basis : Irrespective of the legal formalities and documentation i.e. submission of leave and license agreement, submission of copy of police information record and the payment of Non Occupancy charges to the society. It was also decided to collect the incoming and outgoing charge Rs. 20,000/­ (lump sum) directly from the maintenance bill for a period of 12 months from the owner who will let out his/her flat. The members who have already given their flats on leave and license basis will also have to pay incoming and outgoing charges of Rs. 20000/-. The same is also applicable for Renewal of earlier agreement or for entering into a new agreement for the next period of 12 months. unquote Can the Housing Society charge the few flat owners who have leased their flat such a huge amount. What is the basis for such a charge. The building has 21 flats, ground plus three floors, and has no lift. The tenants do not have parking facility and, in fact, no extra facility. They are already paying the non occupancy charges of ten percent of service charges. It looks like the Hsg Soc is deciding to punish the flat owners for leasing their flats. The building is about to go for redevelopment within a couple of years. We find it unreasonable and want to know how to go about it to stop the HSG SOC from charging the amount. Thank you.
