Anticipatory bail

I am a doctor working in a govt hospital. A patient is admitted in the hospital under me for more then one year. She is fine and has no serious issue, but is not willing to take discharge and go home 9 as probably she has some problems there, neither want to get refereed to some superior hospital. She is ambulatory, taking home food brought by her son and husband. Her husband , on 15.4.18 made a court FIR and accordingly local PS called me under CrPC 41A and all the relevant documents given to I/O. He was cooperating. But as the FIR mentioned several IPC s -viz..323, 344, 491, 276, 504, 506, 120B and especially 276, which has maximum punishment as lif imprisonment if proved, I/O asked me to take AB. But on 3 occasions , when the AB plea was made before the Sessions court U/S 438, the case was not heard by Ld Judge citing that the CD has not yet come. today, ie 2.8.18, same thing happend and next date given after 1 month. It is over 90 days since registration of the FIR. In the mean time, I/O didnt call me anymore.My question is (i) Who's responisibilty it is to bring the CD to Court...is it mine or the Police (ii) If after so many days, no CD and no Charge sheet is filed, is there any more need to get AB?
