Suit for title

Division of Property (not ancestral) among Three Brothers Dispute is as follows [I am Y and (dispute is between X and Y with Z only), and here us means X and Y]: (i). Dispute is on one house situated in Ghaziabad. (ii). We three brothers say X, Y and Z purchased land by taking Bank Loan in 2004 jointly. The bank paid 70% and rest is paid by us (X and Y) which is written the Registry paper. (iii). One brother (Z) did not contribute in construction of the house. But by giving false promises, he began to live in the house after construction by X and Y. But he (Z) tried to usurp the property by occupying majority of the portion against our wishes. (iv). To solve the matter peacefully and under pressure and threat by him (Z), we paid him Rs. 7 lakh to construct 2nd floor and executed a written settlement in 2009 (which is neither registered nor notarized.) to live peacefully in the property. on floor basis (each one get one floor) and with roof jointly. (v). The bank loan instalment was paid by me initially and Z had deposited some amount in my bank account for few years thereafter he defaulted. As per agreement of 2009, he (Z) did not pay any Bank instalment and we (X and Y) paid the entire amount of bank loan through the mutual settlement with the Bank and thereafter the case filed in DRT was revoked by the Bank. (vi). At the same time, he and his wife began to hurt / physically us and our family members. Three criminal cases are filed against them. (vii). Z had filed civil suit in the Ghaziabad for suit for declaration of 2nd floor where he was defeated. (viii). We ( X and Y) filed a civil suit stating that since the agreement is not obeyed by him and most of the resources are arranged by two brothers only, the house should be declared in our name (X and Y) i.e. the name of Z may be deleted. (ix). One lawyer has suggested that we can get seek only (a) Recovery of excess amount paid by X and Y land , bank loan etc. (b) We cannot seek transfer of house in our name as in the land registered deed, his name is included. (x). Now please advice me what sorts of remedy is available to us X and Y a. Is it possible to have house in our name (X and Y) by deleting the name of Z. and what steps should be taken by X and Y for the same. b. Will I get only financial compensation on account of excess amount paid by us (X and Y) in land purchase, electricity, registry, society charge, bank loan etc. and for this what steps should be taken by X and Y for the same.
