Profile loan of a Flat

I had a profile loan in Noida when builder has taken a loan on profile from bank and property is 90% ready and it is agreement between me and builder that builder will pay the emi and after 24 month builder shall rebuy the property and clear the loan. But now builder is delaying the EMI, Can I surrender the property to Bank for loan recovery for which builder still has not given the possession and can Bank auction it without possession letter for loan recovery and if say full loan is not recovered can Bank come after my other assets as Bank has given the loan after a secured asset. 2ndly say I had paid 5 lac interests to the bank in the EMI, can some of this intrest amount to be considered while calcuting the loan recovery in NPA. 3rdly can I file any case to the builder on the basis of call recording I had with builder for all this, can call recording helps in case along with online transaction for the emi amount by builder in my account. 4th , I had an copy of agreement on a 100 rs stamp between me and builder for this profile funding Kindly help for the query, I had been trapped by my own friend into this Regards SK
