Deed of Declaration and formation of flat owners association

I have taken flat in project name "IMP Greens", Smruti Building. I have got my flat possession on oct 2016. At the time of possession builder has taken Rs.26,000/- (for 1 bhk) and Rs.30000/- (for 2bhk) as a recurring maintainance charges in the individual name. and Rs.40000/-(for 1 bhk ) and Rs.50000/- (for 2bhk) as a One time maintainance charges in favor of builders firm saying that after formation of Association he will transfer the money in the association account. we have no option , coz he is refusing to give possession without payment. now builder has returned one maintainance charges some of our flat owners. He has made deed of declration in Feb 2017 in which he has also declares by laws of association without our concern. after that he has individually sale deed of each flat owner. But till date builder has not form in kind of association. 1) In deed of declaration of he has taken rights of terrace ownership. can it be possible to get ownership in name of flat owners association. 2) some of amenities he has not provided during the possession. Can we ask for this to the builder ? 3) He has returned one time maintainance to some flat owners without getting mutual consent from all flat owners. now he his refusing to collect this amount from the flat owners. i think he playing divide and rule policy between us? give me some solution 4) if, which kind of deed (conveyence or deemed ) should we get from builder ?
